Phoenix Smart City App Hack Description The “Phoenix Smart City App Hack” is a competition initiated by the City of Phoenix and organized by the Institute of Digital Progress (iDP) as an open platform for residents in the Greater Phoenix Region wishing to pursue entrepreneurship and create public value for their communities. The 2015 Phoenix Smart City App Hack is part of the larger, “Smart City App Hack” (SCAH), competition initiated by the City of Barcelona and organized by dotopen.
The “Smart City App Hack” brings together a global network of smart cities that face similar challenges and share one vision: to turn citizens into App Makers, empowering them to build apps and businesses that will make for a better city. The Smart City App Hack is sponsored by FIWARE and Mastercard both providing invaluable support including mentorship in their respective areas.
In the Phoenix Smart City App Hack, participants can find inspiration in the cities main themes: urban mobility, energy & emissions, shopping & retail, culture & tourism, and the collaborative city. A local team of mobile experts helps select finalists to build their app over the course of 3 months: from idea to final app. The contest will conclude with a City Finale where the best apps will be chosen and one grand champion will be selected to represent the City of Phoenix at the final award gala at the Smart City Expo 2015, an event to select the top apps at the international level.
Call for Entries, Launch Event, Acceleration Phase and Online Competition The “Phoenix Smart City App Hack” begins in Phoenix, where the contest launches on June 26, 2015 with a press release from Mayor Greg Stanton, Councilman Bill Gates, and the City of Phoenix. This will officially open the “Call for Entries” period where people are invited to submit already built apps or app ideas for consideration for the acceleration phase.
A Launch Event will be held on July 11, 2015 that will focus on team building, concept working, mentoring and workshops on the available resources. After the Launch Event, the “Call for Entries” period will officially close on August 1st, 2015. From all submissions, five top apps, or app concepts, will be selected by a panel of industry professionals and city officials to enter the Acceleration Phase. During this phase, the selected finalists will receive mentorship through a series of workshops with local companies and app development professionals to further develop their app for market adoption and implementation. The acceleration phase will last from August to October.
During this period, a separate “Online Competition” will be held for contestants that were not selected as finalists but still want their apps considered for the City Finale. During this period, other participants (other than the five finalists) can register their finished products at the azidp.com. Any submitted projects will be evaluated by the panel of judges to be selected to pitch at the City Finale.
The contest will conclude with a City Finale where the five finalists, and the best apps submitted during the Online Competition, will compete by pitching their apps live on stage to a panel of judges. Three City winners will be chosen and awarded cash prizes and entrance into the international contest, the Smart City App Hack. One Grand Champion will be chosen and sent, all-expenses paid, to represent the City of Phoenix at the international grand finale at the Smart City Expo 2015 in Barcelona.
Submissions Submissions to the 2015 Phoenix Smart City App Hack are free and open to any individual, entrepreneur, developer, team or firm. All participants must be 14 or older. Underage participants will be considered with written acknowledgement from their parents or legal guardians.
The competition is open to apps running on ANY platform. Web apps are also considered valid.
An entry must: (a) be an original application; (b) be solely owned by the entrant, so that no other party has or can validly claim any right, title or interest, whether known or unknown in the application; and (c) not violate the intellectual property, common law or privacy rights of any other party. An entrant may contract with a third party to assist with the creation of the entry, provided the entrant is the sole owner of all intellectual property in the entry, consisting of the software application.
Applicants can submit more than one app. However, only one app from each applicant can be chosen as a winning app.
Applications must serve one of the areas defined on the competition website – azidp.com. The panel of judges maintains the right to disqualify any app not following these conditions and criteria for participation.
Actual commercial availability at the time of submission is not required but the judges must be able to test the app at the City Finale (either provide a link to a store or to a private hosting of the app).
All pitches, app explanations, and other marketing material can be in local language during the Phoenix Smart City App Hack but must be done in English during the Smart City Expo global final.
Participants may join at any time of the process and even submit an existing, finished app directly to the online competition if they wish, regardless of whether they participate in the Call for Entries period or the Acceleration Phase.
Prizes – Phoenix Smart City App Hack FIRST PRIZE: $3,000, + commemorative plaque + airfare + accommodation + entrance into the Smart City Expo 2015+ entrance into the Smart City App Hack*
SECOND PRIZE: $1,000 + commemorative plaque + entrance into the Smart City App Hack
THIRD PRIZE: $500 + commemorative plaque + entrance into the Smart City App Hack
For all Prizes: Winners-entrants are responsible for payment of all taxes and fees associated with prize receipt and/or use. Each prize check will be mailed to the winner’s address within 60 days of receipt of the signed affidavit(s) of eligibility and liability/publicity release(s) form(s). If a team of individuals, an association, entity or organization is selected as a prize winner, the prize will be awarded to the association entity or organization, which will determine the ultimate disposition of the prize.
*IDP will accompany two members of the winning app challenge team to attend the Smart City World Expo in Barcelona, Spain. IDP will be responsible for all monetary requirements for the winning team representatives including conference entrance and registration fees, airfare , lodging, and per diem for meals (up to and not exceeding three meals per day). Airfare and lodging expenses will only be applied to necessary and reasonable accommodations to allow for adequate travel time and participation at the Smart City World Expo events, and will not extend beyond the completion of the Expo and return to Phoenix.
Prizes – Smart City App Hack For the Final Gala at the Smart City Expo 2015, the top apps from each area (culture and tourism, urban mobility, energy and emissions, shopping and retail, collaborative city) will be chosen from the pool of ALL finalist apps from ALL participating cities. The selection of these fifteen (15) finalists will be done by an international jury formed by partners and mentors from all participating cities. These fifteen (15) finalist apps will be invited to present live at the Final Gala, using a 3-min pitch format in front of a live international jury of experts. A final number of FIVE (5) winners will be chosen at the end of the event, one winner per area, and will be awarded prizes including cash prizes, acceleration trips etc (to be concreted), sponsored by MasterCard, FIWARE and other sponsors.
In case your app is selected as one of the best apps internationally to pitch and compete at the Final Gala at the Smart City Expo, all expenses and travel costs including flight, hotel accommodations, personal expenses, meals, etc. are the responsibility solely of the winner unless otherwise indicated and/or covered by the hosting city as part of the City prize.
Each participant is responsible for obtaining all required travel documents and travel insurance prior to travel. Each winner must have valid passport and visas (if applicable) in order to complete travel to Spain in November. Travel restrictions, conditions and limitations may apply.
Additionally, each city will define its own number of local winners and possible local prizes for the City Finals (details to be concreted individually per each participating city). These local winners will be also invited to participate in the Smart City Expo and present their app, either as one of the 15 finalists (if selected by the international jury) or as invited pitches presenting their app to the audience outside the final competition.
NOTE: In order to be awarded a slot to pitch and opportunity to win one of the prizes, the participant must confirm his or her presence to showcase the app live on stage during the final event. Otherwise, the team/app will be disqualified and a runner-up will be chosen.
Criteria of Winning Submission The criteria that the jury will follow for the evaluation of the finalists/winners are: 1. Addresses the focus areas and solves a real user’s need 2. Quality of user interface 3. Technical and operational feasibility 4. Economic and financial sustainability 5. Creativity and innovation 6. Use of one or more of the resources promoted by the cities, like the FIWARE APIs, Mastercard APIs, Open Data sets, BCN Contactless, iCity APIs, etc.
Selection of the Winner(s) – Judging The selection of finalists and winners will be done by an independent jury formed by representatives from sponsors, city officials, and a panel of mentor/experts that will take part in the process from the beginning of the competition. The judging criteria are those described in section Criteria of Winning Submission, and the decision will be taken by providing an individual score from 1 to 5 for each of the criteria to each participating app and choosing as a winner the app with the highest total score. In order to facilitate the judging process, the complete information of the app profiles as provided by the app owner will pass to the panel of judges, and will be used for evaluation purposes only.
ALL POTENTIAL PHOENIX SMART CITY APP HACK WINNERS ARE SUBJECT TO VERIFICATION BY THE ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SMART CITY APP HACK.
Potential winners must continue to comply with all terms and conditions of these Official Rules. The potential winners will be notified on or about October 17, 2015. The winners will be required to sign and return to the Administrator, within ten (10) business days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable.
If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of an Smart City App Hack prize is disqualified for any reason, an alternate entrant, who receives the highest score of the remaining eligible entrants, will be declared a winner. If a winner is a minor in accordance with the laws of his or her state of residence, at the Sponsors’ sole option, the prize will be awarded to the minor’s parent or legal guardian on behalf of the winner, or, if permitted by applicable law, awarded to the minor directly, provided the minor’s parent or guardian ratifies and signs the affidavit of eligibility, and liability/publicity release.
Other Things to Know Entry Conditions and Release
By entering the Smart City App Hack, each entrant agrees to accept and abide by the following terms and conditions and release: (1) Each entrant agrees to comply with and be bound by these Official Rules and the decisions of the judges’ panel are binding and final in all matters relating to the Smart City App Hack. (2) Each entrant also agrees to release and hold harmless the Partners, Sponsors, the Administrator, and their respective representatives, affiliates, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Smart City App Hack, and all of their respective past and present officials, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability. These claims, expenses, and liability include, but are not limited to, negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant’s submission, creation of an entry, or submission of an entry, participation in the Smart City App Hack, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, transmission, performance, exploitation or use of entry. (3) Each entrant also agrees to indemnify, defend and hold harmless the Partners, Sponsors and the Administrator from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Smart City App Hack and/or the entrant’s acceptance, use or misuse of the prize.
Publicity Except where prohibited, participation in the Smart City App Hack constitutes the winners’ consents to the Partner’s Sponsors’, the Administrator’s and their agents’ use of the winners’ names, likenesses, photographs, voices, opinions, hometowns and states; application screenshots, application videos, application descriptions and commentaries for promotional purposes in any media, worldwide, without further payment or consideration.
General Conditions The Partners, Sponsors and the Administrator reserve the right to cancel, suspend and/or modify the Smart City App Hack, or any part of it, if any fraud, technical failures or any other factor beyond the Partner’s, Sponsor’s and/or the Administrator’s reasonable control impairs the integrity or proper functioning of the Smart City App Hack, as determined by the Partners, Sponsors and/or the Administrator, acting in the exercise of their sole discretion. The Partners, Sponsors and/or the Administrator reserve the right in their sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the Smart City App Hack or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.
Any attempt by any person to deliberately undermine the legitimate operation of the Smart City App Hack may be a violation of criminal and civil law, and, should such an attempt be made, The Partners, Sponsors and/or the Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Partners, Sponsors and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Smart City App Hack; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Smart City App Hack; (4) technical or human error which may occur in the administration of the Smart City App Hack or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Smart City App Hack or receipt or use or misuse of any prize.
Any attempt by any person to deliberately undermine the legitimate operation of the Smart City App Hack may be a violation of criminal and civil law, and, should such an attempt be made, the Partners, Sponsors and/or the Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. The Partners, Sponsors and/or the Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Disputes Each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Smart City App Hack, or any prizes awarded, other than those concerning the administration of the Smart City App Hack or the determination of winners, shall be resolved individually, without resort to any form of class action; (2) any and all disputes, claims and causes of action arising out of or connected with this Smart City App Hack, or any prizes awarded, shall be resolved exclusively by the United States District Court or the Superior Courts of the County of Maricopa, Arizona; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Smart City App Hack, but in no event attorneys’ fees; and (4) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, the Partners, Sponsors, and the Administrator in connection with the Smart City App Hack, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona.
